A client had £350,000 seized in cash. After previously paying tens of thousands in solicitor fees to no avail, they were recommended to this firm.
Partner of the firm, Moira Macfarlane and instructed counsel Rhys Rosser of 2BR, The Chambers of Brian Altman KC and Christine Agnew KC, swiftly dealt with the thousands of pages of evidence being used in the course of the proceedings. With a decreasing amount of time to robustly defend matters, a bundle spanning hundreds of pages of gathered evidence was used to counter argue the submissions being made by the police and their barrister.
A 2 week contested hearing was scheduled.
These proceedings rely on a balance of probabilities for cash to be seized and a suspicion of illegal activity. After numerous legal arguments and negotiations before the court and to the police team, a concession was made that almost half the cash no longer fell under the legal test of seizure.
As a result, this money was safely returned to the client and no prosecution costs needed to be paid.
