It’s been quite a while since Nicholls & Nicholls got a hung jury at trial, and for such a serious offence of murder.
After weeks of expert presentation from our legal team specifically selected for such a contentious case; Tom Crowther KC of 23ES and his junior barrister, Nick Jones of 5 St Andrew’s Hill, made it happen.
It is highly unusual for there to be such a divide on such a serious allegation of murder. In this instance, our client has always said it was someone else.
After numerous experts providing reports regarding how the injury occurred and how particles could be passed between people in close proximity, the case ended with an excellent closing speech based on the evidence that was put before the jury.
After days of deliberation and several weeks of trial, the jury could not come to a decision.
The Prosecution, due to the nature of the allegations, have of course asked for a retrial which will be in the early part of 2025. To our client, they at least have a sense of relief knowing that at least 3, if not more, of the 12 jury members believe them. And that is enough right now for the criminal justice system to work the way it should.
